Terms and Conditions

This statement of Rights and Responsibilities (“The Statement”) governs the relationship between users of Compare Care Homes (“The Site”) and those who interact with the website.  It also sets outs the Rights and Responsibilities of customers and how the content of the website will be managed.

  1. User Online Safety

We do our best to keep Compare Care Homes safe, but we cannot guarantee this.  We need your help in order to do this, which includes the following commitments of all users of the site:

    1. You will not post any content that is hateful, threatening, pornographic, contains nudity, or violence.
    2. You will not post any content that is distressing or which portrays people in an undignified manner.
    3. You will not use compare the care homes to do anything unlawful, misleading, malicious or discriminatory.
    4. You will not collect users information, or otherwise access Compare Care Homes, using automated means (such as harvesting bots, robots or scrapers) without our express written permission.  The data within this website is marked in a particular manner so that any attempt at copying any part of our database can easily be detected and the appropriate action taken, including legal action and or prosecution wherever necessary.
    5. You will not upload viruses or malicious code.
    6. You will not encourage or facilitate any violations of this Statement.
  1. Account Security.

Care home providers and their representatives provide information on care homes that should be factually accurate and up to date.  We would like to ensure that this aim is maintained; and include the following commitments for all customers of the site:

    1. You will keep contact information accurate and up-to-date.
    2. You will not share you password or log-in details with anyone outside of your organisation, and you will not do anything else that may jeopardise the security of your account.
    3. The information submitted is factually accurate and verifiable.
    4. You will not submit information that is deliberately misleading.
  1. Registration
    1. We reserve the right to refuse any application for inclusion on this website
    2. Upon receipt of care home information, we will screen and validate the information against our existing records to assess the quality and accuracy of the information provided.
    3. In order to enable your affiliate status the following minimum information will be required:
      1. Care home name and address details
      2. A list of the registered care categories offered at the home
      3. At least one photo of the care home when viewed externally.
      4. All question fields marked with an asterix.
      5. By submitting information and photographs, you are agreeing that these may be displayed on any part of our website for the purposes of promoting the care home submitted.
  1. Protecting Other People’s Rights

We respect other people’s rights, and expect you to do the same.  In order to ensure this, we include the following commitment for all users of the site:

    1. You will not use our copyrighted material, trademarks, logos, or intellectual property without our prior written permission.
    2. You will not post content or take any other action on the Site that infringes someone else’s rights or otherwise violates the law.
  1. About the information contained on Compare Care Homes.
    1. We will not give or sell your content (our database) to advertisers or third parties for any purpose.
    2. We may collect and share statistical information on searches undertaken, in terms of postcode information and geographic location, and keywords used, with customers and partners to enable us to improve our service to you.
  1. Definitions
    1. By “the Site” we mean the features and services we make available through our domain address www.comparecarehomes.com, including any sub-domains or linking domains.
    2. By “us”, “we” and “Our” we mean comparecarehomes.com, which is a trading name of Peolsford Ltd, and it’s affiliates.
    3. By “Content” we mean the information that you post on www.comparecarehomes.com
    4. By “Contract” we mean the agreement between the Customer and Peolsford Ltd and it’s content.
    5. By “Care home Manager”, we mean the representative of a care home that uploads information into our database.
  1. Responsibility for Content

We aim to maintain a quality database that is freely available to users to assist in their search for a care home.  Whilst we will do our best to verify that the information provided is accurate, we cannot guarantee this and we stress that responsibility for content lies with the care home manager(s).

    1. You may not transfer your rights and responsibilities under this agreement to any other third party without our prior written consent.
    2. We are not a care home provider.  We provide a service that enables you to compare a number of care home services offered.
    3. We make no representations or warranties of any kind in respect of the website or it’s contents and disclaim all such representations or warranties.  In addition, we make no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics on the site.  The information contained on the website may contain factual inaccuracies or typographical errors.  All of our liability howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
    4. Neither we, nor any of our employees, or other representatives, will be liable for loss or damage arising out of, or in connection with the use of the website.  This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation), compensatory, direct, indirect or consequential damages, loss of data or information, income or profit, loss of, or damage to property in claims of third parties.
    5. Notwithstanding the above, none of the exclusions or limitations contained in these terms and conditions are intended to limit any statutory rights that you may have as a consumer which may not be limited or excluded in any way.
  1. Breaches of this agreement and Termination
    1. Either party may terminate the agreement immediately, with notice, if the other commits a material breach of the Terms and Conditions which cannot be remedied.
    2. We reserve the right to temporarily suspend any care home record(s), following a complaint or negative media coverage, of a serious nature, relating to the services offered by that care home.  Before doing so, we will notify the care home manager in writing to explain our reasons for doing so.
    3. We will determine whether there has been a breach of the terms and conditions through your use of the site.  If a breach of these terms and conditions has occurred, then we may take such action as we deem appropriate including denying you access to the website, bringing legal proceedings against you and disclosing such information to such legal or regulatory bodies as we feel appropriate.
